Web Site Development Agreements and Proposals
Will Watson Design shall e-mail you (Client) a Web Site Development Agreement and/or a Web Site Development Proposal for you (Client) to sign & date along with a postage pre-paid self-addressed envelope for you (Client) to mail back to Will Watson Design. In-person contract review, signing and notarization may be arranged upon the Client's and/or Will Watson Design's request. Travel to a Client requested location may incur additional cost. Contract/Agreement Renewals
Will Watson Design shall (at its discretion) offer the Client the opportunity to renew a voided and/or expired contract/agreement for undesirable delays caused by the Client resulting in the expiration of an active contract/agreement for an additional cost to recover any lost revenues for utilizing additional business resources to meet new project delivery deadlines (see fees table below).
Expired Contract Renewal and Associated Administration/Production Fees:
- 60-Day Project Completion Deadline / Launch Date: 45% of Original (Expired) Contract Price
- 45-Day Project Completion Deadline / Launch Date: 55% of Original (Expired) Contract Price
- 30-Day Project Completion Deadline / Launch Date: 65% of Original (Expired) Contract Price
- 15-Day Project Completion Deadline / Launch Date: 75% of Original (Expired) Contract Price

Project Payment Terms and Procedures
- $0.01-$1,000.00 = 100% Up Front Payment Required
- $1,000.01-$2,000.00 = 75% Minimum Deposit Required
- $2,000.01 or Higher = 50% Minimum Deposit Required
- Flexible Payment Plans Are Available (WAC) on Web Design Projects Exceeding the Cost of $5,000.00

Will Watson Design shall commence work on an order/project once the Client has submitted all deliverables to Will Watson Design, and payment has been received and processed. Once the Client has placed an order, Will Watson Design shall contact the Client in order to confirm his/her order and method of payment.
Will Watson Design shall provide the initial web design sample to the Client within 3 to 7 working days (depending on the specifications and/or chosen package). Will Watson Design shall make available and/or post the initial sample to a secure website, accessible only by Will Watson Design and the Client. The Client shall then have the opportunity to view his/her web design sample and also have the opportunity to provide his/her feedback concerning the design of the sample.
Will Watson Design shall analyze the Client’s feedback and revise the sample, if requested to do so by the Client in writing. The revised sample shall be represented to the Client within 3 working days. Will Watson Design shall keep revising within the Client-required guidelines which does not constitute more than a 30% overall re-design or complete re-design of the initial project scope until Client is reasonably satisfied.
Each revising period shall last approximately 1 to 3 working days. Once the sample has been approved by the Client, Will Watson Design shall proceed with the delivery phase. All requested files are zipped and emailed to the Client or placed on an FTP server for download. The Client shall have 3 days to respond to each set of concepts/revisions submitted to the Client for review. If after 3 days the Client has failed to respond, Will Watson Design shall assume the Project is complete and the Project shall be deemed as complete.
Refunds
The Client can request in writing that a full refund be given for any reasonable purpose and/or unforeseen circumstances within 30 calendar days after entering into a verbal or written agreement with Will Watson Design and remitting any portion of a required project's deposit (downpayment) or full amount. Refund requests should be submitted via the electronic contact form.
If the Client is not reasonably satisfied with the initial design concepts or design compositions provided by Will Watson Design, the Client may request (in writing) and receive a full or partial refund within the first 30 days of entering into a verbal or written agreement with and/or hiring Will Watson Design to develop the Client's Website. The Client shall not be awarded a full or partial refund after 30 Days and/or once the Client requests additional revisions for any of the initial concepts; the Client shall forfeit his/her right to a full or partial refund accordingly.
Excessive Project Delays
Will Watson Design deems excessive project delays to be any delays that halt or hinder the progression of a project for more than 21 calendar days. Will Watson Design provides quality service and support, and makes every reasonable effort to maintain the progression of projects, and all expected delays and/or delays exceeding 10 calendar days must be communicated to Will Watson Design in writing.
If the Client causes excessive project delays (e.g. excessive delays being more than 21 calendar days) by not providing Will Watson Design with all necessary content (and confirming in writing that all project materials have been submitted) including but not limited to marketing materials, ad copy, text, graphics, photos, audio files, video files, etc. within 30 calendar days after signing a Web Site Design Proposal, Web Site Development Contract and/or any other associated Web Site Development Agreement, the Client shall forfeit his/her right to a full or partial refund accordingly.
Copyright and Trademarks
The Client unconditionally guarantees that any element of text, photos, symbols and/or graphics furnished to Will Watson Design for inclusion in the design sample do not infringe upon any copyright or trademarks that have already been established by another individual or organization. The Client shall hold harmless, protect, and defend Will Watson Design and its partners, vendors, affiliates and sub-contractors from any claim or suit arising from the use of such elements furnished by the Client.
Materials Ownership and Licensing
Ownership of the final composition shall become the property of the Client in accordance with all local, state or federal laws having unlimited, indefinite, and royalty-free use of the composition for any purpose deemed reasonable and legal. Will Watson Design retains the right to display any portion and/or all of the composition in it's portfolio and advertising materials. All designs, concepts, slogans or other materials displayed, presented or submitted to the Client which are not selected by the Client remain the full property of Will Watson Design.
